Electronic filing is mandatory statewide in civil cases. In criminal cases, attorneys have been required to file electronically in Caldwell County since July 1, 2019, under Court of Criminal Appeals Order 16-003.
File through an Electronic Filing Service Provider approved by the Office of Court Administration. Some providers charge for filing or for card processing; free options exist.
Two things attorneys get caught by
Sensitive data. Read Part 5 of the governing rules closely — it controls filing documents containing sensitive data not specifically required by statute or court rule.
Courtesy copies. If you are appearing in court for a hearing within 24 hours of e-filing, provide a courtesy copy of the filing to the court.
The governing orders are Supreme Court Order 15-9205 and the joint Final Approval of Rules Governing Electronic Filing in Criminal Cases (Court of Criminal Appeals Misc. Docket No. 15-004).
